On January 30, 2017, Mark Magee, age 69 from Belle Chasse, was arrested for Sexual Battery and Cruelty to a Juvenile that occurred between January 2014 to December 2016. The victim was between the age of 14 to 16 when the incidents took place.
Magee was indicted by a Grand Jury for the offenses of Sexual Battery and Cruelty to a Juvenile and eventually tried before a jury on May 9, 2022 in Plaquemines Parish. The jury found Magee guilty on both counts.
Sentencing was held before Judge Michael Clement on Tuesday, September 7, 2022. At the sentencing the victim gave a powerful Victim Impact Statement. She addressed the defendant first by stating “A lot of people tell me that everything happens for a reason and that I am who I am because of what you did to me, but I refuse to believe that. They say my trauma made me stronger, again, I refuse to believe that. I made myself stronger by digging myself out of that dark place and dealing with consequences that weren’t mine to deal with. I would have been GREAT no matter what. You just made it harder.”
The victim then addressed Judge Clement telling him – “Because of him, I can’t walk into a hardware store without the smell suffocating me. Because of him, pregnancy was the scariest thing because once again, I had people touching me where I didn’t want to be touched and there was nothing, I could do about it.”
Judge Clement sentenced Magee to the maximum of 10 years on each charge with the Louisiana Department of Corrections for Sexual Battery and Cruelty to Juvenile. The sentences will run concurrently.
